Privacy Policy & Messaging Terms

This policy explains what information we collect, how we use it, and how our text-messaging program works — including how to stop receiving messages at any time.

1Who we are

DigiSoft LLC, DBA DigiDog Tech (“DigiDog Tech,” “we,” “us,” or “our”) is a web design, hosting and marketing technology company based in Kokomo, Indiana.

This policy covers information we collect through our website and through the services we provide to our own customers and prospects. When we build or operate a system on behalf of a client, that client is responsible for their own privacy practices and their own messaging consent; we act as their service provider.

2Information we collect

We collect only what we need to answer you, provide our services, and run our business.

Information you give us

  • Contact details — name, business name, email address, mailing address and phone number, when you submit a form, book a call, or contact us.
  • Messages — the content of emails, text messages, form submissions and voicemails you send us.
  • Project information — details about your business that you share so we can quote or perform work.
  • Billing information — for customers, the details needed to invoice and collect payment. We do not store full payment-card numbers; card payments are handled by our payment processor.

Information collected automatically

  • Usage and device data — IP address, browser and device type, pages viewed, referring page and timestamps.
  • Cookies — see Cookies & analytics.
  • Call and message metadata — when you call or text a number we operate, we may record the number, date, time and duration, and the content of messages.

3How we use information

  • To respond to your enquiries and provide quotes and proposals.
  • To deliver, maintain and support the services you have engaged us for.
  • To send service and transactional messages — appointment confirmations, project updates, invoices and receipts.
  • To send marketing communications where you have consented, and only until you opt out.
  • To operate, secure, troubleshoot and improve our website and services.
  • To keep business records and comply with our legal and tax obligations.

We do not sell your personal information, and we do not rent or trade it.

4Text messaging (SMS)

We use text messaging to communicate with people who have asked to hear from us. This section applies in addition to the rest of this policy.

How you opt in

We send text messages only to people who have given express consent — for example by submitting a form on our website that states you agree to receive text messages, by ticking a consent box, by texting us first, or by giving us your number and permission in the course of doing business with us. Consent to receive marketing text messages is never a condition of purchasing anything.

What we send, and how often

  • Conversational and customer-care messages — replies to your enquiry, scheduling, and project communication.
  • Service and transactional messages — appointment reminders, status updates, invoice and payment notices.
  • Marketing messages — only where you have separately consented to receive them.

Message frequency varies with the nature of our conversation or your project.

Cost

Message and data rates may apply.Your mobile carrier’s standard rates apply to messages you send and receive; we do not charge you for them.

How to stop messages

Reply STOP to any message to be removed. You will receive a single confirmation that no further messages will be sent, and we will stop. You may also reply UNSUBSCRIBE, CANCEL, END or QUIT, or contact us using the details in Contact us. To rejoin, text START or simply ask us.

Carriers and delivery

Message delivery depends on your mobile carrier and is not guaranteed. Mobile carriers are not liable for delayed or undelivered messages. Supported carriers may change without notice.

We do not share mobile opt-in data. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information may be shared with subcontractors who provide support services on our behalf, such as customer service providers and the messaging platforms that deliver messages for us; those parties are prohibited from using it for any other purpose. Text-messaging originator opt-in data and consent are never shared with any third parties for their own marketing.

Messages we send for our clients

Where we operate a messaging system on behalf of a client business, messages are sent under that client’s own brand, from their own number, under their own consent and privacy practices. Those messages are governed by that business’s policy, not this one, and opting out of their messages does not opt you out of ours (or the reverse).

5How we share information

We share personal information only in these circumstances:

  • Service providers — hosting, email delivery, messaging, scheduling, payment processing and accounting vendors who process information on our behalf, under contract, and only as needed to provide their service.
  • Legal reasons — where required by law or legal process, or to protect our rights, safety or property, or that of others.
  • Business transfer — if the business is sold or reorganised, information may transfer as part of that transaction; we will give notice if this happens.
  • With your direction — where you ask us to share it.

As stated above, mobile opt-in data and consent are excluded from all sharing other than the support subcontractors described in Text messaging.

6Cookies & analytics

Our website uses a small number of cookies to keep the site working — principally to keep you signed in to the customer portal and to remember the contents of your cart. You can block or delete cookies in your browser settings; if you do, signing in and ordering may not work correctly.

We do not use third-party advertising, retargeting or behavioural-tracking cookies on this site. If that ever changes, we will update this section and say exactly what we use before turning it on.

7How long we keep it

We keep personal information for as long as needed to provide our services and to meet our legal, tax and accounting obligations, after which it is deleted or anonymised. Records of opt-outs and do-not-contact requests are kept indefinitely, because that is the only way to reliably honour them.

8Security

We use reasonable administrative, technical and physical safeguards to protect information, including encrypted connections and access controls. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

9Your choices & rights

  • Marketing email — click unsubscribe in any marketing email.
  • Text messages — reply STOP (see Text messaging).
  • Access, correction or deletion — contact us and we will respond as required by applicable law.
  • Do not sell — we do not sell personal information, so there is nothing to opt out of.

Depending on where you live, you may have additional rights under state or national privacy law. Contact us and we will honour any rights that apply to you.

10Children’s privacy

Our services are intended for businesses and adults. We do not knowingly collect personal information from children under 13. If you believe a child has provided us information, contact us and we will delete it.

11Changes to this policy

We may update this policy from time to time. We will change the “Last updated” date above, and for material changes affecting how we message you we will provide additional notice.
